Problem with Sortables

I'm having a problem implementing sortable lists.

<div id="id0"><h3>Date and Time</h3><div class="moduleContent"></div></div>
<div id="id14"><h3>Calculator</h3><div class="moduleContent"></div></div>

Sortable.create("leftcol", {tag:$$('div'), treeTag:$$('pre')});

When I try to debug with Safari's Web Inspector, I get the following error:
@@@TypeError: Result of expression 'tagName.toUpperCase' [undefined] is not a function. dragdrop.js:932@@@

Am I doing something wrong, or is there a bug here?

When creating a bug report, be sure to include as much relevant information as possible. Post a an example that shows off the problem. Preferably, <b>alter the unit tests</b> and show through either changed or added tests how the expected behavior is not occuring.
